1. Кто мы

2. Какие данные мы получаем

• Заявка в Telegram: ответы анкеты (например, имя, род занятий, опыт, цели, уровень английского), ваш Telegram-юзернейм и идентификатор чата, а также сообщения, которые вы отправляете боту. Ваше взаимодействие с самим Telegram регулируется политикой конфиденциальности Telegram.
• Сайт: наши инфраструктурные провайдеры (например, Cloudflare) обрабатывают технические данные запросов (IP-адрес, метаданные запроса) для защиты сервиса и обезличенной статистики посещаемости — без cookies и без межсайтового отслеживания.
• Пиксель Meta и cookies: на этом сайте работает пиксель Meta, который ставит в вашем браузере cookies (_fbp, _fbc — около 90 дней) и передаёт Meta данные о посещении: адрес страницы, источник перехода, IP-адрес, данные браузера и идентификаторы из этих cookies. Условия, на которых он запускается, описаны в разделе 4. Других рекламных трекеров на сайте нет. Раздел приложения (app.bwith.app) пикселя не содержит вовсе.
• Запись о рекламном переходе: если вы пришли на сайт по рекламе Meta, адрес страницы содержит идентификатор клика (fbclid) и метки рекламной кампании. Мы сохраняем их на наших серверах под коротким случайным идентификатором, который добавляется к ссылке на Telegram-бота — так мы понимаем, какая реклама привела к заявке. В ЕЭЗ, Великобритании и Швейцарии (а также если вы отклонили баннер или ваш браузер посылает сигнал Global Privacy Control) идентификатор клика и идентификатор из cookie пикселя сохраняются только с вашего согласия; без него сохраняются только метки кампании — какая реклама, но не кто вы. Если согласие дано, вместе с ними сохраняются ваш IP-адрес и данные браузера с этого визита: они нужны, чтобы Meta приняла серверное событие конверсии (раздел 4), и хранятся ровно столько же, сколько сама запись. Записи, не связавшиеся с заявкой, удаляются через 7 дней; связавшиеся — через 90.
• Запись вашего ответа о согласии: ваш ответ («принять» или «отклонить») сохраняется в вашем браузере — и одновременно записывается на наших серверах, чтобы мы могли подтвердить, что согласие было получено, как того требует статья 7(1) GDPR. В этой записи только: сам ответ, время, версия текста уведомления, правовой режим (ЕС / США / остальной мир), адрес сайта и случайный идентификатор записи, который создаётся в вашем браузере. Ни имени, ни email, ни IP-адреса, ни каких-либо иных данных, позволяющих установить вашу личность, эта запись не содержит: она подтверждает, что и когда было согласовано, а не кем. Отдельно — как и для любого обращения к серверу — технический журнал хранит IP-адрес и данные браузера ограниченное время (раздел 7), а запись о согласии содержит идентификатор того самого запроса, поэтому пока журнал существует, их можно сопоставить; после его удаления запись о согласии остаётся без такой связи.

3. Как мы используем данные

Для рассмотрения заявки и отбора участников; для организации и проведения программы; для связи с вами о программе через Telegram (или по email, если вы его оставили); для улучшения программы; для защиты от злоупотреблений. Для жителей ЕЭЗ и Великобритании правовые основания: исполнение договора / предоставление запрошенной услуги (заявка и участие), законный интерес (безопасность, улучшение программы) и согласие (маркетинговые сообщения — если и когда вы на них подписались).

4. Реклама и пиксель Meta

Мы размещаем рекламу в сервисах Meta (Facebook, Instagram) и используем на этом сайте пиксель Meta, чтобы понимать, какая реклама приводит людей на сайт, и показывать рекламу тем, кто уже был на сайте (в том числе через «похожие аудитории», построенные на этих данных). Ваше взаимодействие с рекламой внутри Facebook и Instagram регулируется политикой конфиденциальности Meta.

Когда он запускается. Если вы находитесь в ЕЭЗ, Великобритании или Швейцарии, пиксель не загружается вообще, пока вы не нажмёте «Принять» в баннере согласия: до этого момента к Meta не уходит ни одного запроса. Правовое основание — ваше согласие (ст. 6(1)(a) GDPR); отозвать его можно в любой момент, и это так же просто, как дать. В остальных странах пиксель работает по умолчанию, а отключить его можно в любой момент через ссылку «Настройки cookie» внизу страницы.

Серверные события конверсии (Conversions API). Сама заявка происходит в Telegram, где пиксель не работает. Поэтому, если вы пришли по рекламе и на сайте действовало согласие на пиксель, при начале и при отправке заявки, связанной с этим рекламным переходом, мы передаём Meta событие конверсии с нашего сервера. Оно содержит: тип события («начало заявки», «заявка отправлена»), время, идентификатор рекламного клика, идентификатор из cookie пикселя, а также ваш IP-адрес и данные браузера (user-agent) с того самого визита на сайт — без них Meta не принимает такое событие. Ни имя, ни контакты, ни ответы анкеты в этих событиях не передаются. Их разрешает то же согласие, что и пиксель, — данное на сайте в момент перехода: без него серверные события не отправляются.

Совместный контроль. В части сбора данных на сайте и их передачи в Meta мы и Meta Platforms Ireland Ltd. выступаем совместными контролёрами (в значении ст. 26 GDPR — см. решение Суда ЕС по делу Fashion ID, C-40/17). Рамки этого распределения заданы условиями Meta для бизнес-инструментов, включая дополнение о контролёрах. За дальнейшую обработку данных внутри своих сервисов Meta отвечает самостоятельно как контролёр.

Жителям США. Мы не продаём персональные данные за деньги. При этом передача данных Meta для рекламы может считаться «продажей» или «передачей» (sharing) в целях таргетированной рекламы по законам ряда штатов. Для посетителей из США мы включаем режим ограниченного использования данных (Limited Data Use) на стороне Meta, соблюдаем сигнал браузера Global Privacy Control, а отказаться можно на странице Не продавать мои данные.

Как отказаться. Ссылка «Настройки cookie» внизу главной страницы (на этой странице её нет — она не выполняет скриптов); настройки рекламы в вашем аккаунте Meta; отраслевые страницы отказа youronlinechoices.eu и optout.aboutads.info; настройки cookies в вашем браузере. Отказ не влияет на возможность подать заявку и участвовать в программе.

5. Кому передаются данные

Сервис-провайдерам, на которых работает программа: Telegram (платформа, через которую работает бот), Cloudflare (CDN и защита сайта), облачный хостинг, провайдеры доставки email (если вы оставили email), — а также в случаях, когда раскрытие требуется законом. Отдельно и на условиях раздела 4 — Meta, которой пиксель передаёт данные о посещении сайта, а наш сервер — события конверсии по рекламным переходам. Содержание заявки — ответы, сообщения, контакты — в Meta не передаётся: серверные события сообщают только сам факт начала или отправки заявки по конкретному рекламному клику. Мы не продаём ваши данные за деньги.

6. Международная передача

Данные обрабатываются в США. Для жителей ЕЭЗ и Великобритании: там, где это применимо, используются признанные механизмы защиты — сертификация провайдеров по EU-U.S. Data Privacy Framework и/или стандартные договорные условия (SCC).

7. Сроки хранения

Данные заявки и участия — на время программы и до 12 месяцев после её окончания, если вы не продолжаете участие в наших программах и не попросили удалить их раньше. Технические журналы хранятся ограниченный срок, необходимый для безопасности. Cookies пикселя живут около 90 дней и удаляются раньше, если вы отзываете согласие или очищаете браузер. Записи о рекламных переходах (раздел 2) хранятся 7 дней, если переход не привёл к заявке, и 90 дней, если привёл. Запись вашего ответа о согласии хранится в вашем браузере до тех пор, пока вы её не удалите, а её копия на наших серверах — до 2 лет: это доказательство законности уже состоявшейся обработки, и оно должно жить дольше, чем сама обработка. Сроки хранения данных на стороне Meta определяет Meta.

8. Ваши права

Вы можете запросить доступ к своим данным, их исправление, удаление, ограничение обработки, возражать против обработки, получить копию данных и отозвать согласие. Согласие на рекламные cookies отзывается ссылкой «Настройки cookie» внизу главной страницы; для жителей США отдельная страница Не продавать мои данные. Жители ЕЭЗ и Великобритании также вправе подать жалобу в надзорный орган своей страны. Напишите на contact@engsaleslab.com или боту — мы ответим в течение месяца. Просьбы об удалении мы выполняем для всех, независимо от страны; удаление необратимо: персональные ключи шифрования уничтожаются, после чего данные невозможно восстановить, в том числе нам самим.

9. Возраст

Программа предназначена для лиц старше 18 лет.

Privacy Policy

1. Who we are

English Sales Lab is an educational program operated by IVASHCHENKO LLC, 7901 4th St N Ste 300, St. Petersburg, FL 33702, United States (“we”). Contact: contact@engsaleslab.com. This policy explains what data we receive when you use engsaleslab.com and apply through our Telegram bot, and what we do with it.

2. What we collect

• The Telegram application: your application answers (for example your name, occupation, experience, goals and English level), your Telegram username and chat identifier, and the messages you send the bot. Your use of Telegram itself is governed by Telegram’s privacy policy.
• The website: our infrastructure providers (for example Cloudflare) process technical request data (IP address, request metadata) to protect the service and produce aggregate, cookieless visit statistics — no cross-site tracking.
• The Meta pixel and cookies: this site runs the Meta pixel, which sets cookies in your browser (_fbp, _fbc — about 90 days) and sends Meta data about your visit: the page address, the referring source, your IP address, browser data and the identifiers in those cookies. Section 4 describes the terms on which it runs at all. There are no other advertising trackers on this site, and the application area (app.bwith.app) carries no pixel whatsoever.
• The ad-click record (attribution): if you arrive here from a Meta ad, the page address carries a click identifier (fbclid) and campaign tags. We store these on our servers under a short random reference, which is added to the Telegram bot link — that is how we tell which ad led to an application. In the EEA, the UK and Switzerland (and whenever you decline the notice, or your browser sends the Global Privacy Control signal) the click identifier and the pixel cookie id are stored only with your consent; without it we store the campaign tags alone — which ad, not who you are. Where consent is given, the IP address and browser data from that visit are stored alongside them: Meta requires both before it will accept the server-side conversion event (section 4), and they are kept for exactly as long as the record itself. Records that never link to an application are deleted after 7 days; linked ones after 90.
• The record of your consent answer: your answer (“accept” or “decline”) is stored in your browser — and also recorded on our servers, so that we can demonstrate consent was given, as Article 7(1) GDPR requires. That record holds only: the answer, the time, the version of the notice text, the regime it was given under (EU / US / rest of world), the site address, and a random record id minted in your browser. It contains no name, no email, no IP address and nothing else that could identify you: it evidences what was agreed to and when, not by whom. Separately — as for any request to a server — our technical log keeps the IP address and browser data for a limited period (section 7), and the consent record carries that request’s id, so for as long as the log exists the two can be matched; once it is deleted the consent record stands without that link.

3. How we use it

To review applications and select participants; to organize and run the program; to contact you about it via Telegram (or email, if you provided one); to improve the program; and to prevent abuse. For EEA/UK residents the legal bases are: performance of a contract / providing the service you requested (your application and participation), legitimate interest (security, program improvement), and consent (marketing messages, if and when you opt in).

4. Advertising and the Meta pixel

We advertise on Meta platforms (Facebook, Instagram) and run the Meta pixel on this website, so that we can tell which ads bring people here and show ads to people who have already visited — including through “lookalike” audiences built from that data. Your interactions with ads inside Facebook and Instagram are governed by Meta’s own privacy policy.

When it runs. If you are in the EEA, the UK or Switzerland, the pixel does not load at all until you press “Accept” in the consent prompt — until then not a single request goes to Meta. The legal basis is your consent (GDPR Art 6(1)(a)); you can withdraw it at any time, and withdrawing is exactly as easy as giving. Everywhere else the pixel runs by default and you can turn it off at any time through the “Cookie settings” control in the page footer.

Server-side conversion events (Conversions API). The application itself happens in Telegram, where the pixel cannot run. So if you arrived through an ad and the pixel consent was in effect on this site, we send Meta a conversion event from our server when an application linked to that ad click is started and when it is submitted. It carries: the event type (“application started”, “application submitted”), the time, the ad-click identifier, the pixel cookie id, and the IP address and browser data (user agent) from that same website visit — Meta does not accept such an event without them. No name, no contact details and none of your application answers are ever in these events. They are authorised by the same consent as the pixel — the one given on this site at the time of your visit: without it, no server-side event is sent.

Joint controllership. For the collection of data on this site and its transmission to Meta, we and Meta Platforms Ireland Ltd. act as joint controllers within the meaning of GDPR Art 26 (see the CJEU’s Fashion ID judgment, C-40/17). That allocation is framed by Meta’s Business Tools terms, including the controller addendum. Meta’s further processing inside its own services is Meta’s responsibility as a controller in its own right.

For US residents. We do not sell personal information for money. Sending data to Meta for advertising may nevertheless count as a “sale” or a “share” for targeted advertising under several state laws. For US visitors we enable Meta’s Limited Data Use mode, we honor the browser-level Global Privacy Control signal, and you can opt out on our Do Not Sell or Share page.

How to opt out. The “Cookie settings” control in the footer of the home page (it is not on this page, which runs no scripts); your ad preferences in your Meta account; the industry opt-out pages youronlinechoices.eu and optout.aboutads.info; and your browser’s own cookie controls. Opting out has no effect on your ability to apply or take part in the program.

5. Sharing

With the service providers the program runs on — Telegram (the platform the bot operates through), Cloudflare (CDN and site protection), cloud hosting, and email delivery providers (if you provided an email) — and where disclosure is required by law. Separately, and on the terms in section 4, with Meta — to which the pixel sends data about your visit to this site, and our server sends conversion events for ad-driven applications. The content of your application — answers, messages, contact details — is not sent to Meta: the server-side events carry only the fact that an application tied to a specific ad click was started or submitted. We do not sell your data for money.

6. International transfers

Data is processed in the United States. For EEA/UK residents, recognized safeguards apply where required — our providers’ certification under the EU-U.S. Data Privacy Framework and/or standard contractual clauses (SCCs).

7. Retention

Application and participation data is kept for the duration of the program and up to 12 months after it ends, unless you continue in our programs or ask us to delete it earlier. Technical logs are kept for the limited period security requires. Pixel cookies last about 90 days, and sooner if you withdraw consent or clear your browser. Ad-click records (section 2) are kept for 7 days when the click never leads to an application, and 90 days when it does. The record of your consent answer stays in your browser until you remove it, and its copy on our servers is kept for up to 2 years: it is the evidence for processing that already happened, so it has to outlive the processing it justifies. Retention on Meta’s side is determined by Meta.

8. Your rights

You may request access, correction, deletion, restriction, object to processing, receive a copy of your data, and withdraw consent. Consent to advertising cookies is withdrawn through the “Cookie settings” control in the home page footer; US residents have a dedicated Do Not Sell or Share page. EEA/UK residents may also complain to their national supervisory authority. Write to contact@engsaleslab.com or message the bot — we respond within a month. Deletion requests are honored for everyone, regardless of country, and erasure is permanent by construction: we destroy the per-person encryption keys, after which the data is unrecoverable, including by us.

9. Age

The program is intended for adults 18 and older.

10. Changes

Updates to this policy are posted on this page with a new date at the top.
